see for now, we do have some fog expected to develop throughout the morning but temperatures are crisp. it's definitely cooler out there than it was at this time yesterday. you want to grab that jacket but you can leave the umbrella at home. we have a warmup on the way. we'll talk about just how warm it's going to be in your city over the course of the weekend and who might actually break some records. that's coming up. 4:31. first, it's a friday. we don't want any problems. a man to get us around the issues is mike inouye. >> we have some camera-shy road crews because i was just looking at some flashing lights southbound side with these taillights passing by university avenue. they were in the roadway causing quite a commotion up until just about 30 seconds ago when they cleared the screen. now we have construction going on down toward embarcadero. expect a little slowing as you head south. there you see that yellow popping up as they move. no problem. a normal blow of traffic across the dumbo as well as the san mateo bridge.

no slowing across those spans. typical overnight maintenance. i do have an accident to tell you about across the bay coming up. >> thank you very much, mike. it is 4:32. it is a stunning denial after a sexual abuse victim files a lawsuit. but the moraga school district is firing back. it appears to be blaming the former student for her own abuse saying that he contributed to it. she said she was sexually abused by twoers in the '90s. she sued the district and three former administrators claiming school staff knew about the abuse and did nothing to stop it. now the district is denying it, calling her actions at the time both careless and reckless, ultimately making her responsible. we reached out to the district for comment. no one has returned our calls. she says she's got plenty to say.

>> seeing myself on that campus, the 12, 13, 14-year-old and to read those words and to think that they thought i was negligent, i was responsible, it was heart-breaking for me. >> she's taking action against the district to make sure sexual abuse is taken seriously. a student at a san jose elementary school is suing the principal, a teacher and the school district for negligence and sexual abuse. the lawsuit claims the girl was abused by her teacher two years ago and the principal failed to act on those accusations. this lawsuit coming as the criminal trial against that principal is expected to wrap up sometime today. she's facing charges for failing to report the abuse allegations against craig chandler. she admits in court yesterday she knew about the parents' concerns with chandler but they did not report him because he assured her he was not doing anything inappropriate. cann chandler was later arrested and

charged with committing lewd acts on five children. prosecutors have charged a school administrator for not calling authorities in a situation like this. the chp is patrolling the streets of oakland this morning following an order from governor brown. chp officers are working with opd to help increase patrols in high crime areas and help stop violent crime. so far this year oakland has had 108 homicides. >> a definite decrease in calls for emergency services, in violent crimes occurring and an increase in community relations. >> the chp worked with oakland police between 2007 and 2010. the program ended because of a lack of funding. the partnership will last for at least three months. the help comes just hours after the death of a popular oakland business owner. police say 50-year-old wilbur bartly was shot and killed as he was closing his cell phone store

on international boulevard. this morning he's being remembered for all the good things he did for his community. >> kids come by here, aman, he'd treat everybody good. the only thing i can think of him doing wrong would be nice. >> he lived just a few blocks from the store. the mother of mikayla garic will have to wait more weeks to see if a bone fragment belongs to her daughter. it was found several weeks ago but test results have been delayed. hayward police say it could be another six weeks before the tests come back. millions across the northeast waking up to another day without power. this morning the death toll still rising. the devastation continues to reveal new complications.

danielle leigh has the latest on the cleanup. >> reporter: electric repair vehicles and volunteers from out of state are working to get the lights back on in the northeast. for the millions without power, those lights have already been out too long. >> there's people that have nothing. they have just the clothes on their backs. you know, it's -- >> reporter: frustrating, i bet, to have to wait? >> very frustrating. >> reporter: desperation is now replacing sadness. >> but you need to come here and help us. we need assistance, please. >> reporter: crews are trying to salvage mere shells of once thriving communities, but residents locked out of their homes for safety reasons are losing their patience. >> it's the gas mains we're scared of. we're trying to shut the gas mains off. >> i don't care about a house. i conveyare about your life. >> reporter: on the roads, hours long traffic jams and gas lines

so long people are arriving on. >> the we've been in line about two and a half hours. two and a half hours. >> reporter: in new york city many are questioning the mayor's priorities as the city is preparing for a yearly marathon. >> we're pulling bodies out of water. you see the disconnect here? >> reporter: the pain from sandy still fresh in communities anxious to recover. in atlantic city, new jersey, i'm an danielle leigh, nbc news. this morning we're hearing firsthand accounts of what it was actually like when hurricane sandy rolled ashore now that jfk land guardia are back up and running. we were there when a number of flights landed at sfo last night. a lot of people telling us firsthand exactly what they witnessed. >> i have a 15-year-old daughter who was terrified and she thought that we were going to die. >> telephone poles that have been cracked at the base. >> mile to mile lines for gas.

people about 50 deep with gas cans because the electricity is spotty so some places have electricity, some places don't. >> so much devastation out there. some bay area help is on the way to victims. yahoo! helping spearhead hurricane relief efforts here in the bay area. so far more than $450,000 have been donated. the american red cross silicon valley chapter reporting $2 million raised over the past two days. that is great. it will definitely be help. we will be doing our one-hour telethon on nbc to benefit the victims of sandy. the "today" show's matt lauer is hosting appearances by kevin bacon, jon stewart, tina fey and jimmy fallon as well as musical performances by the boss, bruce springsteen, billy joel and jon bon jovi. hurricane sandy coming together airing right here at 8:00. in the meantime the u.s. government is warning people to watch out for scams in the wake of the storm.

authorities say many bogus charities are asking for donations through e-mail, text messages and twitter. they may also call. the best way to protect yourself is to check out the charity before you donate. if you don't know what it is, look it up online. sites like ftc.gov and give.gov help you spot the legitimate charities. 4:39. let's check in with meteorologist christina loren to check out your friday morning. >> hey, good morning to you. always want to remind everybody that we live in earthquake country and it's always a good idea to make sure you have as much gas as possible in your tank and you want to collect those canned goods and water every time you go to the store because you never know when it could happen. it's a great reminder. temperatures are nice and comfortable. we're at 52 in san francisco so not too cold there. what i will point out right off the bat, temperatures running 5 to 8 degrees cooler in your north bay cities this morning so

keep that in mind as you make your way out the door. 45 in novato, 52 in san francisco. now take you down south. 51 in san jose and 46 down in gilroy. adds we head throughout the day today, we've got a good-looking day shaping up. there's a weak ridge of high pressure that will start to break down in the first half of the day. as a result we could see some north bay showers but not expecting much. looking pretty good, nice and clear. not a whole lot of fog as the atmosphere is mixing around with this area of low pressure just to our north. we stop the clock at 5:00 p.m. and light, spotty showers moving north of the golden gate bridge. highs today will be comfortable. we've got a good-looking fall day shaping up with temperatures in the 70s. 73 in livermore, high pressure is the reason why. we'll take you through your full forecast, weekend forecast looking good in most cities. that's coming up in my seven-day. first we want to check your drive. good morning, mike. >> good morning, folks.

the freeway moves smoothly as far as the live shot goes. on the south on my map we're looking at an accident northbound 880 toward marina boulevard. there's no real slowing but there's report of a slowing at basically the on-ramp itself. it sounds like it's off or maybe in the slow lane. farther north construction both sides of the freeway north and south between 16th or as you approach 16th. but no major slowing. there is a little slowing approaching the bay bridge but a light flow there. a live look outside and there we are looking at the incline and also the decline, folks coming with the headlights heading out of the city and there is the city. beautiful view. clear skies across the bay. >> looks pretty good. thanks, mike. tonight cal will host its first-ever friday night football game at the new memorial stadium and the city of berkeley telling people to take public transit. several streets around the cal campus will be closed starting

at 3:00. those same closures happen during saturday games, but tonight's game during rush hour, which means a lot more people will be on the road not headed to the game. there will be free shuttles from the rock ridge b.a.r.t. station and amtrak station. cal playing the washington huskies. kickoff is at 6:00 p.m. >> pretty cool, friday night lights. >> it looks really, really nice. 4:42 right now. big news expected from washington just over an hour from right now. why it could be a make-or-break moment on the campaign trail. plus it is already on sale halfway around the world. the coveted apple ipad mini. >> breath taking. >> we're going to show you what bay area stores are doing today in preparation for sales.

4:45 now. takinge ing ing a live look at . we'll have an update on the lockout coming up. the bay bridge looks good. we're expecting the winds to pick up throughout the day today. there's a storm system sitting to our north. as we get throughout the day your temperatures will jump from the 40s and 50s into the 70s. we've got a good-looking day, just about as cool as it was yesterday right at the coast. you'll get a little warmer in your inland cities with a lack of fog. the system will keep things nice and mild for us and then we start to really warm up as we get into next week. we could be talking about the potential for temperature records right here in the bay area. today looking good. 73 in livermore, 73 in fairfield and 70 out in concord. the weekend looks good. saturday, sunday, beautiful for outdoor activities. tuesday, election day, super tuesday. 86 degrees. the weather will be super as

well. 77 degrees at the coast. wednesday into thursday things start to change. another storm system moves in. this one is panning quite a bit of moisture. enjoy the sunshine while it lasts. that's the message. >> thank you very much. we're keeping a very close eye on the markets this morning. the monthly jobs report is due out in just about an hour from right now, so for that and the look at the rest of your news before the bell we say good morning to amanda drury live at cnbc world headquarters. a very crucial report this morning, the last one before the tuesday elections. >> reporter: it really is very important, jon. in fact we've got the october jobs report and this is, as you say, the final bit of numbers before election day next week. now economists are expecting another month of modest and not stellar job growth. forecasts are calling for an increase of 125,000 in company payrolls and the unemployment

ralt rate is expected to be 7.9%. you will not see the full impact of hurricane sandy until next month's jobs report and stocks did rally yesterday, so the hope is that the economy is slowly but surely getting better. the dow jumped about 136 points yesterday to 13,232. the nasdaq was up by 42 points and in fact november is historically the best month for the markets during a presidential election year for the dow jones. as for apple's innovation, it is the ipad mini and it hits stores in two dozen countries today. apple sold out preorders for the device last weekend, but already stores in parts of asia have seen some lines. but this time around those lines are smaller. in fact several apple stores in new york city are going to be closed today for obvious reasons and the power outages from hurricane sandy could stop them from opening for another couple of days. we'll have to wait and see. microsoft is reportedly working

with its asian suppliers to test its own smartphone design but it is unclear if the device will go into mass production. elsewhere, reports say that the phone's screen is between 4 and 5 inches. the iphone 5 has a 4 inch screen while the samsung galaxy s-iii measures four inches. payroll is front and center. back to you. >> thank you very much. we'll check back with you a little later on. turning now to decision 2012 and, yes, as we're saying only four days left before the presidential election. president obama and governor romney out on the road again today making a mad dash across the electoral maps seeking those big, important swing state votes. we get the latest from nbc's tracie potts. >> reporter: both candidates land in ohio today. so far here's what their travel schedules look like. governor romney visits seven

states, including a rally in ohio tonight, with 100 supporters, politicians and celebrities. in virginia last night, he argued the president is running out of steam. >> he was just the other day talking about saving characters on sesame street and playing word games with my name and attacking me on a regular basis and attacks that he knows aren't true. >> reporter: president obama also visits seven states between now and election day with a focus on ohio. his must-win state. he'll be there every day between now and the election, making his closing argument, highlighting higher home prices and victories overseas. >> al qaeda has been decimated, osama bin laden is dead. so we've made real progress these past four years. >> reporter: the president picked up an endorsement from new york mayor michael bloomberg. earlier this week bloomberg said new york was too busy cleaning up for the storm for a

welcome back, everybody, on a friday. how about this, a nice look at the space shuttle "atlantis" moving to its brand new home today. not quite as spectacular as what we saw with "endeavour" out here. the final resting place is the kennedy space center visitor complex just ten miles from its current home at the vehicle assembly building. that journey started early this morning. 4:54 this morning. have you ever wanted to meet a real-life world series champion? guess what, here's your chance. angel pagan will be at the macy's men's store tomorrow at 11:00. the giants outfielder meeting

hayward side. i'll check on that and let you know if there are any delays. the southbound drive great visibility, back to you. coming up, the cleanup continues in the northeast, but not everyone is being welcomed with open arms. why some utility crews from alabama told their help -- they were told their help was not needed. also two men walk right into a 7-eleven and they walk out with a bag full of cash. we'll have all the details coming up.
